Health care in America encompasses two areas: medical care and non-medical care.  Both are considered health care but are licensed and managed separately by a State's health and social service care systems.  This article focuses on non-medical care provided in a community care setting, which may have support services that include medical services for an HCBS consumer/recipient.  

A waiver is defined as an act or instance of waiving a right or claim.  In HCBS service cases the claim is on Medicare and Medicaid money.  The HCBS waiver program allows 1000s of types of unique HCBS programs to get paid although these programs don't meet the requirements for the normal medical, nursing and intermediate care programs covered under Medicare and Medicaid.  

No matter what program, one must understand that: the care that is required to be provided is always based on the person's (consumer's) level of need. HCBS Standards for Community Care Cases
Home and Community-Based Services (HCBS) Service Standards: Typically groups homes for the developmentally disabled receive funding for their services through the federal MediCare waiver program.  Sometimes the State will have federal waiver agreements which pay for services to the elderly and mentally disabled in community care settings.
